Terms of Service

These Terms of Service ("Terms") govern your access to and use of AiHub Pro ("Service", "we", "us", or "our"), operated by Eclectic Emporium. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. The Service includes generative AI that can produce mature or sensitive material and is not intended for minors. By registering or using the Service, you represent that you are 18 or older and that the information you provide is accurate and current. We may suspend or terminate accounts if we reasonably believe a user is under 18.

2. Accounts

You are responsible for keeping your login credentials confidential.
You are responsible for all activity under your account.
Notify us promptly of any unauthorized use of your account.
We may suspend or terminate accounts that violate these Terms or applicable law.
Some features require a verified email address before purchase or continued generation.

3. Tokens & payments

The Service currently sells one-time token packs (not monthly subscription allowances). Token balance is debited when you run paid generations and related AI features.

Never expire: Unused tokens from one-time packs do not expire and remain on your account until used, while your account remains in good standing.
Stack / roll over: Buying additional packs adds to your existing balance. Unused tokens carry over; they are not wiped on a calendar "billing cycle."
Different models, different costs: Faster or lighter models use fewer tokens; premium image, video, or music models use more. Displayed costs in the Studio are estimates; the server charge at generation time is authoritative.
Purchases: Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms.
Refunds: Except where required by law, purchases are final once tokens are credited. We may, at our discretion, refund or reverse charges for failed generations or clear billing errors. Failed generations that are refunded in-product restore tokens when our systems successfully reverse the charge.
Prices: Shown in USD and may change with notice for future purchases (existing unused tokens keep their value as balance units, not as a fixed USD cash claim).
Future subscriptions: If we later offer recurring monthly plans, those terms will be disclosed at purchase. Unless a plan expressly says otherwise, monthly allowances would be separate from one-time pack balances that never expire.

4. AI services & third-party models

The Service uses third-party cloud and AI providers to host infrastructure and run model inference. We do not publish a full vendor or product list in these Terms. Categories of processors (for example hosting and payments) are described in our Privacy Policy.

Inputs and outputs: Prompts, reference media, and other data you submit ("Inputs") and content returned by models ("Outputs") are treated as your content between you and us. You retain applicable rights in your Inputs and Outputs, subject to these Terms and third-party model licenses.
Training: We do not sell your prompts or outputs as training data. Operational retention (for example generation history) is described in our Privacy Policy. Upstream model or infrastructure providers may process Inputs/Outputs solely to fulfill your request under their own terms and data practices.
Third-party models: Models offered through the Service are third-party products. Their licenses and acceptable-use policies may apply to you. We and those providers do not warrant model security, accuracy, or availability. Suspected violations of provider terms may result in suspension of access without notice.
Provider routing: To fulfill a generation, Input/Output data may be sent to the infrastructure of the selected model provider or intermediary. That provider's privacy and security terms may apply to that hop.
No accuracy warranty: Outputs may be inaccurate, incomplete, biased, or unsuitable. You are solely responsible for reviewing Outputs before any use (including commercial or public use).
Capacity & rate limits: We and our infrastructure providers may throttle, queue, or limit requests to protect network integrity and fair use.

5. Acceptable use

You will not use the Service—or cause us to process content—that is illegal, harmful, or prohibited by applicable model or infrastructure providers. Without limitation, you agree not to:

Generate, upload, store, or distribute child sexual exploitation or abuse material or content that facilitates human trafficking. We treat this as zero-tolerance and may report to authorities (including NCMEC where applicable).
Generate content that is otherwise illegal, or that infringes intellectual property or other rights.
Generate content that discloses others' sensitive personal information without authorization, incites or exploits violence, or is intended to defraud.
Distribute malware, phishing, crypto-mining abuse, or other technical abuse; or use the Service for volumetric attacks or to intentionally harm another party's rights.
Harass, threaten, or abuse others; or generate non-consensual intimate imagery of real people.
Attempt to reverse-engineer, scrape, probe, or overload the Service or its APIs beyond normal product use.
Circumvent authentication, rate limits, token accounting, email verification, or access controls.
Resell raw access to underlying model or infrastructure APIs as a pass-through without our written consent.

We may remove content, refuse generations, suspend accounts, or cooperate with providers or law enforcement when we reasonably believe these Terms or the law have been violated. We may act without prior notice when appropriate.

6. Content ownership & licenses

You retain ownership of your prompts and of Outputs we deliver to you, to the extent ownership is assignable under law and under the applicable model license.
You grant us a limited license to process Inputs and Outputs to operate the Service (run models, store history, provide support, prevent abuse, and improve reliability).
Some models restrict commercial use, redistribution, or other uses. You are responsible for complying with the model provider's terms for any commercial or public use of Outputs.
We do not claim ownership of your Outputs as a condition of use, except for our own branding, software, and the Service itself.

7. Your responsibilities to end users & third parties

You are responsible for your use of Outputs and for any support obligations you may owe to your own clients or audience. We are not obligated to provide support to third parties on your behalf regarding content you generate.

8. Intellectual property (Service)

The Service software, UI, documentation, and branding are owned by Eclectic Emporium / AiHub Pro and its licensors. These Terms do not grant you rights to our trademarks, logos, or source code except as needed to use the Service as offered.

9. Disclaimers

THE SERVICE—INCLUDING ALL MODEL OUTPUTS AND UNDERLYING THIRD-PARTY AI OR CLOUD SERVICES—IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT OUTPUTS WILL BE ACCURATE, LAWFUL FOR YOUR USE CASE, OR FREE OF HARMFUL CONTENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (OR, IF GREATER, ONE HUNDRED U.S. DOLLARS WHERE REQUIRED TO MAKE THIS LIMIT ENFORCEABLE). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM PERMITTED.

11. Indemnity

You will defend and indemnify us against claims arising from your Inputs, Outputs, misuse of the Service, or violation of these Terms or third-party model terms, except to the extent caused by our willful misconduct.

12. Suspension, termination & data

We may suspend or terminate access for Terms violations, non-payment, abuse, legal risk, or to protect the Service or its infrastructure. You may stop using the Service at any time. Account deletion and data practices are described in the Privacy Policy. We may retain records as needed for legal, security, or accounting purposes.

13. Modifications

We may modify features, models, pricing for new purchases, or these Terms. Material Terms changes will be noted by updating the date above and, where practical, a notice in the Service or by email. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by applicable law. Disputes will be resolved in a court of competent jurisdiction, without prejudice to mandatory consumer protections that apply where you live.
